DUI recognition awards may prompt unfair traffic stops in New Jersey

|

Sometimes states put on campaigns to target certain crimes. They also may
recognize officers that make arrests. This week a New Jersey police officer
was recognized for making the most DUI arrests in the state. By recognizing
arrests, police departments may encourage police officers to pull people
over, when they aren’t necessarily doing anything wrong, and subjecting
them to embarrassing tests on the side of the road.

This recognition also suggests to the public that all the people arrested
for alleged DUI were guilty, which might not be the case. Everyone who
is arrested and charged with a crime has the right to defend themselves.
Those accused of a DUI might be wise to speak with an experienced criminal
defense attorney.

If a police officer pulls someone over who hasn’t been drinking, or
has maybe had only one drink, and made a mistake while driving, they may
feel they are being unfairly treated. Police will sometimes ask people
to perform tasks on the side of the road that many people might not be
able to perform without alcohol in their system. This means the tests
might not necessarily prove a person is under the influence.

Police may also try to intimidate a person or make them nervous which could
influence their ability to perform these tests. It is important that police
follow all procedures and laws. If they violate a person’s rights
during a DUI arrest in New Jersey, that person might be able to have the
charges reduced or dropped. A criminal defense attorney can address your
unique situation.
