New Jersey law, unlike other States, breaks down criminal offenses into “Indictable Crimes” and “Disorderly Persons Offenses.” Most other States refer to such criminal offenses as “Felonies” and “Misdemeanors.”
What Are Indictable Crimes?
Under New Jersey law, there are 4 levels of Indictable Crimes. Most other States refer to what New Jersey calls “Indictable Crimes” as “Felonies.” “Indictables” are “graded” as First Degree Crimes (the most serious), Second Degree Crimes, Third Degree Crimes and Fourth Degree Crimes (the least serious).
- A First Degree Crime is punishable by 10-20 years imprisonment
- A Second Degree Crime is punishable by 5-10 years imprisonment
- A Third Degree Crime is punishable by 3-5 years imprisonment
- A Fourth Degree Crime is punishable by up to 18 months imprisonment.
