What Is Robbery?

In New Jersey, robbery occurs when an individual takes someone else’s property from their person by use of force. There are two factors which set robbery apart from other related crimes such as burglary or theft. First, property must be physically taken off a person’s body or taken while in their direct presence. This can include grabbing a wallet out of a person’s hand or pickpocketing their cell phone. In both cases, the person must be physically present when the item is stolen. The other aspect which differentiates robbery from other crimes is the use of force or violence. This can include direct force, such as a shove or strike, or the threat of violence such as with intimidation.

For further clarification, the term theft, also known as larceny, generally refers to the act of taking someone’s property without their consent. Although theft and robbery are similar, in cases of theft, the person does not have to be present when the crime occurs. Burglary refers to the act of unlawfully entering a private building with the intention of committing a crime.

Penalties for Robbery in New Jersey

A person can be charged with either first or second degree robbery depending on the severity of their crime. First degree robbery occurs when the assailant is armed with a dangerous weapon or inflicts serious bodily harm. A conviction for first degree robbery can be punished by a prison sentence ranging from 10 to 20 years. If a prosecutor cannot prove that these circumstances applied to the robbery, a second degree charge is likely. A conviction for second degree robbery can carry a prison sentence ranging from 5 to 10 years.
