Penalties for Selling
The punishments in the state of New Jersey for drug sales are harsh, especially depending on the type of drug, the amount you’re selling, and to whom you sell it. For example, selling drugs to a minor or a pregnant woman can result in double the penalty. The penalties for selling cocaine will increase the more cocaine you are caught with. For example, selling 0.05 oz. or less could lead to a fine of up to $75,000 while having more than 5 oz. can result in a fixed prison term and a fine of up to $300,000. Marijuana, a less addictive drug, could lead to a 1.5 to 5 year jail sentence or fines ranging from $25,000 to $150,000 depending on the amount and if you sold it within 1,000 feet of a school or school bus.
Penalties for Trafficking
Trafficking occurs when a person is found to be in the possession of a large amount of controlled substance with the intent to distribute. The substance is usually classified into Schedule I and Schedule II drugs. Schedule I drugs include such substances as marijuana and heroin, while Schedule II drugs include such substances as methamphetamine and cocaine. If someone is convicted of trafficking any of these drugs, it will result in a mandatory jail sentence and fine, according to state law. You are also more likely to be prosecuted by the federal government for the same crime, which doesn’t count as double jeopardy.
