Penalties for Possession& Sale of Heroin
It is against the law to possess any amount of heroin. No matter how small the amount, possession of heroin is considered a crime of the third degree, which is punishable by a maximum prison sentence of five years and a fine of up to $35,000. Additionally, a six-month driver’s license suspension also applies.
The following are the penalties upon conviction for possession with intent to distribute or sell:
- Less than half an ounce of heroin – Crime of the third degree
- Maximum prison sentence of five years
- Fine of up to $75,000
- More than half an ounce and less than five ounces of heroin – Crime of the second degree
- Prison sentence between five and ten years
- Five ounces or more of heroin – Crime of the first degree
- Prison sentence between ten and 20 years
- Fine of up to $500,000
